wow, the sooner bush is out of office and we can start hearing about REAL problems like the largest national debt in the history of the country, the better.

speaking as someone who at one point was INTIMATELY involved with electronic communications monitoring, this really isn't that bad. They're not saying that they're going to monitor everything you say and do, and arrest you for swearing at a little old granny over MSN..

They're just saying that the facilities need to be monitored to allow the ABILITY to wiretap.

The Patriot act is probably going to be re-written, and it'll be set such that wiretapping (of any sort) will still require a warrant.

Did anyone catch the Condoleeza Rice testimony today? What a farce.

yeah because trying to hold back terrorism isnt a problem and doesnt affect us... Even though a huge reason we are in this debt is because of terrorism as well.... so by trying to keep nukes outa your cities its costing us a few bucks....

agreeing with darry... they'r not out to bust little kids talking trash... tehy'r just trying to keep their doors open, incase a situation does arise... so unless your a terrorist too i dont see why this is a problem

An interesting book to read on this topic is "A Handmaids Tale" by Margret Atler (I think)

Read through all the oppressed woman stuff and get to the restrcition of liberty stuff.

Scary how easy it is.

If the FBI wants to wire tap IM services, they can just go get a warrent, they don't need any of these special rules for back doors into ISPs. I am sure the FBI has plenty of judges in their pockets that they can just go to for a warrent. And dont tell me they dont, because there is always an government official thats in bed with some one that can get them something they cant. Frankly with all the stuff I talk about with my friends through IMs probably has me on a the CIA and FBI watch list as a probably terrorist. We talk about explosives and how to use them for various jobs, what firearms to use when shooting at soft(read human) and hard targets(read armored vehicles) for are various RPGs(read shadowrun) that we play. But that does not make me a terrorist.

Don't be ignorant.

The facilities to do an electronic wiretap don't exist in a standard install; you need to put applications in place just to do it - what the FBI is requiring of ISPs is to install those programs, so that IM wiretapping is POSSIBLE, period.

Again, don't be ignorant. Wiretapping of IM services, to a large degree, is not currently in place. A lot of corporate America already does it - I know my company does - so having commercial ISPs do the same for private individuals really isn't anything new.

To be perfectly honest, you have likely already agreed to monitoring of your electronic communications as a part of signing up for your online service.. Yeah, that long "Acceptable Use Policy" that you skipped to the end of, or just checked the box saying that you read it, without really reading it.

Yes, I understand that this opens the door for potential violations of civil liberties - but at the same time, if you're not doing anything wrong, who cares?

And, FYI.. I know for a FACT that I'm on several watch lists. Why? because a) I'm a foreign national; b) I'm a retired military officer; and c) I choose not to blindly follow any law or rule that is laid down without being aware of it. That's why I understand the basics of the Patriot act, and while I don't like portions of it, I understand that sections are necessary for the good of our society as a whole.

Always bear in mind that the letter of the law ought to support the SPIRIT of the law.. sometimes it doesn't. That's why laws change. I fully expect the patriot act will either be repealed completely, or it will be amended as a result of the ACLU's current lobbying.

They still dont need to have special rules, they can just go out a get a warrent, but thats how I feel. I mean there are plenty of judges in the states that would gladly give them one for what ever purpose they have in mind.

Yes, the FBI DOES pretty much get whatever warrant they need.. that's because they're the FBI. Why should there be a lot of hassle for that?

At the same time, if an FBI agent requests a warrant "just because I feel like it," they're going to get turned down, because they aren't showing probable cause.

No judge would put his career in jeopardy for signing off on a warrant that wasn't for a legitimate purpose.

I know that most judges out there would not put there jobs on the line when it comes to handing out warrents. But all I am saying is that they dont need a back door to any and every ISP operating in the US.
